B2B prospecting — including cold calling and direct outreach — can be lawful under the GDPR where a legitimate interest exists (Art. 6(1)(f) GDPR). Contacting a company that is actively recruiting in order to offer relevant candidates is a typical case where such an interest can be established.

“Legitimate interest” is not a blanket permission. It requires a documented three-step assessment before you rely on it:

  1. Is the interest legitimate? A commercial interest in business development is generally recognised as such.
  2. Is the processing necessary? Could the same goal be achieved through less privacy-intrusive means?
  3. Does the legitimate interest override the rights of the individuals concerned? Even in a B2B context, named contact persons — HR managers, department heads — are natural persons. Their data carries full GDPR protection, and this balance must be assessed and documented.

Even where contact data originates from publicly accessible sources such as job boards or company career pages, this does not automatically permit its use for a different purpose.
